There are five exemptions to extinguishment of mechanically propelled vehicular rights on dual status routes. The onus is on the user to prove that rights should not be extinguished, based on one or more of the exemptions. This has been tested on Garburn by the Secretary of State, and no exceptions have been shown to exist. Therefore, it is a criminal offence to use a motor vehicle on Garburn Pass without lawful authority.
