U5051 and U5052 Parkamoor (December 2002): Discretionary Traffic Regulation Order
Parkamoor Map (opens Document Library)
U5051 Parkamoor to High Nibthwaite only will be open for May 2006
Sections 66 and 67 of the Natural Environment and Rural Communities Act 2006 came into force on 2 May 2006. These relate to the extinguishment of mechanically propelled vehicular rights on ‘dual status’ routes (public footpath or bridleway and Unclassified County Roads). You can read more about the NERC Act on our Green Road Management page.
This has major implications for this route and the network of routes in the west of Grizedale Forest.
U5051 Grizedale to High Nibthwaite
Grizedale to High Parkamoor (grid reference SD 336943 to SD 309926)
This section is closed to mechanically propelled vehicular traffic.
This is a dual status route and after commencement of the NERC Act only bridleway rights remain. The vehicular rights are extinguished from Grizedale to High Parkamoor.
High Parkamoor to High Nibthwaite (grid reference SD 309926 to SD 294897)
This section is open.
The section from High Parkamoor to High Nibthwaite (grid references SD 309926 to SD 294897) is a Unclassified County Road only and the presumed mechanically propelled vehicular rights remain. You can only access this route from High Nibthwaite and then have to turn round and drive back the way you came.
We are working with Cumbria County Council to decide what will happen to the discretionary Traffic Regulation Order on the U5051. Further information will follow.
Other routes in Grizedale that are affected include:
U5052 Satterthwaite to Parkamoor (grid reference SD 337920 to SD 312924)
This section is closed to mechanically propelled vehicular traffic.
This is a dual status route and after commencement of the NERC Act only bridleway rights remain. The mechanically propelled vehicular rights are extinguished from Satterthwaite to Parkamoor.
U5053 Grizedale (grid reference SD 324923 to SD 318930)
This section is closed to vehicular traffic.
This is a dual status route and after commencement of the NERC Act only bridleway rights remain. The mechanically propelled vehicular rights are extinguished.
U5049 Grizedale to Coniston (grid reference SD 331942 to SD 318971)
This section is closed to vehicular traffic.
This is a dual status route and after commencement of the NERC Act only bridleway rights remain. The mechanically propelled vehicular rights are extinguished from Grizedale to Coniston.
The overall effect is that there are now no vehicular routes in Grizedale Forest to the west of the Grizedale Visitor Centre.
Exemptions
There are five exemptions to extinguishment of mechanically propelled vehicular rights on dual status routes. The onus is on the user to prove that rights should not be extinguished, based on one or more of the exemptions. Until then, mechanically propelled vehicular rights remain extinguished.
